Short answer: owning two or three holiday lets on the Costa Cálida does not automatically make you a business. Under Spanish law, what triggers autónomo registration and IVA is how you let — specifically whether you provide "hotel-style" services (cleaning during the stay, daily breakfast, reception, laundry) — not simply the number of homes you own. Pure room-and-keys lets, even several of them, are usually declared as ordinary rental income on Modelo 210 (if non-resident) and stay IVA-exempt. Add hotel services, and you move into professional-landlord territory: autónomo registration with the Agencia Tributaria and the social-security Tesorería General de la Seguridad Social, plus 10% IVA on each booking.
This guide explains exactly where the line sits in Murcia (Costa Cálida), what changes when you cross it, and how the tax and paperwork differ. If you are still choosing a rental model, read it alongside our overview of tourist rental licences and VUT/VFT rules for 2026 and the Costa Cálida and Almería buy-to-let yields guide.
The dividing line is the type of service, not the number of properties. Spanish tax doctrine (and the Agencia Tributaria's own criteria) treats short-term holiday lets as a business activity — requiring autónomo registration and charging 10% IVA — when you offer services "typical of the hotel industry" (servicios propios de la industria hotelera). Offer only the property itself, and your income stays a passive rental, exempt from IVA and declared as rental income.
Hotel-type services that push you into business territory include:
Services that do not count against you — these are considered normal to any let:
So an owner with three Mar Menor apartments let purely as self-catering accommodation is generally not running a business for tax purposes — even with dozens of bookings a year. An owner with a single villa who serves breakfast and cleans daily probably is.
Separately from the hotel-services test, Spanish income tax (IRPF) has a historic rule that long-term letting counts as an economic activity only if you employ at least one full-time member of staff dedicated to it. For short-term holiday lets the service test above is what matters in practice. The upshot: there is no magic number — not two, not five — that automatically turns you into an autónomo. The Agencia Tributaria looks at the substance of what you provide.
Yes — and this comes first, whatever your tax status. On the Costa Cálida (Región de Murcia), every short-term holiday let must be registered as a Vivienda de Uso Turístico (VUT) with the regional tourism register before you advertise it. That is a licensing question, entirely separate from whether you register as autónomo. You can hold several VUT registrations and still not be a "business" for tax. For the mechanics of registration, numbers and platform display rules, see our dedicated guide on the VUT/VFT tourist rental licence in 2026.
If you let without hotel services, you are taxed on the rental income — not as a trading business. For non-resident owners this is declared on Modelo 210 to the Agencia Tributaria. The rate depends on where you are tax resident:
| Owner's tax residence | Tax rate on net rental profit | Can deduct costs? | Filing frequency |
|---|---|---|---|
| EU / EEA resident | 19% | Yes — proportion of IBI, community fees, insurance, repairs, agent fees, interest | Quarterly when let |
| Non-EU resident (e.g. UK, USA) | 24% | No — taxed on gross rental income | Quarterly when let |
Spanish tax residents declare the same income through their annual IRPF return instead. For the full mechanics of IBI and Modelo 210 for a holiday home, read our Costa Cálida holiday home taxes guide, and if you are unsure which category you fall into, our explainer on the 183-day tax residency rule.
Crucially, this type of let is IVA-exempt. You do not charge your guests 10% IVA, because without hotel services the let is treated like residential accommodation, not a tourism service.
Once you cross into business activity — because you provide hotel-style services, or you choose to formalise a genuinely professional operation — three things change at once:
| Passive let (no hotel services) | Professional / autónomo (hotel services) | |
|---|---|---|
| Autónomo registration | Not required | Required (Modelo 036/037 + RETA) |
| Social security | None | Monthly autónomo contributions |
| IVA on bookings | Exempt | 10% IVA charged (Modelo 303 / 390) |
| Income tax vehicle | Modelo 210 (non-resident) / IRPF (resident) | Business profit — IRPF / permanent establishment |
| VUT tourist licence | Required | Required |
| Deduct running costs | EU/EEA residents only | Yes, as business expenses |
For a non-EU owner (UK, US) who cannot deduct costs under Modelo 210, running a genuine business and deducting expenses can look attractive on paper. But the social-security contributions, accountancy fees and IVA administration usually outweigh the benefit unless you are operating several properties at scale as a true trading business. Most owners with two or three self-catering Costa Cálida homes are better off keeping it passive. This is a decision to run past a Spanish tax adviser — the figures here set the framework, not personal advice.
Some investors hold multiple rentals through a Spanish SL (sociedad limitada) rather than personally. That is a different structure with its own corporate tax, bookkeeping and cost implications, and it does not remove the VUT licensing requirement or the hotel-services IVA test. Mediter currently has 8,214 properties for sale across the coasts, and the Costa Cálida around the Mar Menor is one of the most popular zones for buyers planning holiday lets — compact apartments and villas with pools that let well through the long Murcian season. Because Murcia's resale ITP fell to 7.75% under Ley 3/2025 (many websites still quote the old 8%), the entry cost on a resale rental here is noticeably lower than on the Costa Blanca in the Comunidad Valenciana. We publish honest, current prices for each town on our area pages so you can model realistic yields before you commit.
Whatever tax model you later choose, the purchase costs come first. On the Costa Cálida (Murcia), resale ITP is 7.75% (Ley 3/2025); a new build instead carries 10% IVA plus 1.5% AJD stamp duty. The tax base is the higher of the price you pay or the Catastro's valor de referencia — a point most rental-income articles skip entirely. Add notary, land registry, lawyer (~1% + IVA) and a gestoría, and realistic totals on top of the price are roughly 10–13% for a resale and 12–15% for a new build. Our guide to the Costa Cálida reservation deposit explains what is refundable if a deal falls through.
There is no fixed number. Registration as autónomo is triggered by providing hotel-style services (cleaning during the stay, breakfast, reception, laundry), not by owning two, three or more properties. Several self-catering lets without those services are still taxed as passive rental income.
Only if you provide hotel-style services, in which case the reduced 10% IVA applies and you file Modelo 303 and Modelo 390. A pure self-catering let is IVA-exempt — you charge guests no IVA.
Without hotel services, through Modelo 210 to the Agencia Tributaria, taxed at 24% on gross income (no cost deductions, because the UK is outside the EU/EEA), filed quarterly for the periods you let.
Yes. Every short-term holiday let on the Costa Cálida must be registered as a Vivienda de Uso Turístico with the Región de Murcia tourism register before advertising, regardless of your tax status.
Correct for passive lets on Modelo 210: EU/EEA residents are taxed at 19% on net profit and may deduct a proportion of IBI, community fees, insurance, repairs and agent fees; non-EU residents pay 24% on gross income with no deductions. Registering as a business changes this, allowing expense deductions but adding social security and IVA.
Enrolling in the autónomo scheme (RETA) with the Tesorería General de la Seguridad Social does bring you into the public system — one reason some genuine operators formalise. See our healthcare for expats guide for the wider picture.
