Tourist Rental Licence in Andalusia 2026 — Complete Guide

What Is a VUT Licence?

A VUT (Vivienda con Fines Turísticos) is the official registration required to legally rent out a property for short-term tourist stays in Andalusia. Without it, advertising or renting your property on platforms like Airbnb, Booking.com, or Vrbo is illegal and can result in significant fines.

The VUT is governed by Decree 28/2016 of the Junta de Andalucía, with subsequent amendments tightening requirements in response to the growth of short-term rentals.

Who Needs a VUT Licence?

You need a VUT if you want to rent out a residential property in Andalusia on a short-term basis (typically less than 2 months) to tourists or visitors. This applies to:

  • Entire apartments or houses rented to holidaymakers
  • Properties advertised on booking platforms
  • Properties rented directly to tourists (even without platform advertising)

You do not need a VUT for long-term rentals (12+ months) governed by the LAU, or for mid-term rentals (typically 2–11 months) that are not marketed as tourist accommodation.

The Community Vote — The Biggest Hurdle

If your property is in a building with a community of owners (comunidad de propietarios), the community has the power to restrict or ban tourist rentals. Under Spain's Horizontal Property Law (LPH), a three-fifths (3/5) majority vote of owners can:

  • Prohibit tourist rentals entirely within the building
  • Set conditions or limitations on tourist lets
  • Require additional contributions from owners who rent to tourists

This has become a major issue on the Costa del Sol and Costa Almería, where some communities have voted to ban short-term lets. Always check the community statutes and minutes of recent AGMs before purchasing a property for tourist rental.

Municipality Restrictions

Individual municipalities in Andalusia are increasingly imposing their own restrictions on tourist rentals:

  • Málaga city: Has introduced zoning restrictions limiting new VUT registrations in the historic centre and certain saturated areas
  • Sevilla: Similar zoning controls in the old town
  • Marbella and Estepona: Monitoring tourist rental density and considering restrictions
  • Smaller towns: Many are developing their own urban plans that either restrict or facilitate tourist rentals

How to Register — Step by Step

  1. Verify eligibility: Confirm the property meets all requirements and is not in a restricted zone
  2. Check community statutes: Ensure tourist rentals are not prohibited by the community of owners
  3. Prepare documentation: Habitation licence, NIE, property deed, community permission (if applicable)
  4. Submit your declaration: File the declaración responsable (responsible declaration) with the Junta de Andalucía's Tourism Registry (Registro de Turismo de Andalucía)
  5. Receive your NRA number: Once processed, you receive a registration number (NRA — Número de Registro Andaluz) that must appear on all advertising
  6. Register with SES Hospedajes: Register with the police guest registration system for reporting all guest stays

The NRA Number

Your NRA (Número de Registro Andaluz) is your official registration number. It must be displayed on:

  • All platform listings (Airbnb, Booking.com, Vrbo, etc.)
  • Your own website if applicable
  • Any advertising material

Platforms are now actively removing listings without a valid NRA number.

SES Hospedajes — Guest Registration

All tourist accommodation providers in Spain must register guest details with the police through the SES Hospedajes system. This requires:

  • Collecting passport or ID details from all guests over 14
  • Submitting the information electronically within 24 hours of check-in
  • Retaining records for a minimum period

Fines for Non-Compliance

InfractionFine Range
Operating without VUT registration€2,000–€150,000
Failure to display NRA number€2,000–€18,000
Failure to register guests (SES)€600–€30,000
Not meeting minimum standards€2,000–€18,000

Tips for Property Investors

  1. Buy with a licence in mind — check community rules and municipal restrictions before purchasing
  2. Existing VUT properties are premium assets — a property with an active VUT registration is worth more than one without, especially in restricted areas
  3. Consider Costa Almería — fewer restrictions and growing demand make it an attractive alternative to the more saturated Costa del Sol market
  4. Stay compliant — the Junta is actively inspecting and fining non-compliant operators
